1st Contact & Conference Call with the Arbitrator
Conference Call With Arbitrator Osborne: On August 11, 2011 the Union and Canada Post had their 1st conversation with Arbitrator Osborne. (see posting below entitled “1st Contact With The Arbitrator-Urban Bargaining Unit“) Unfortunately the conference call was cut short, due to the fact that the Union’s legal council was not present due to an emergency.
During the conference call, the Union informed the employer and the arbitrator that we plan to challenge Labour Minister Raitt’s appointment of Arbitrator Osborne on the basis of legal precedents established by the Ontario Court and the Supreme Court of Canada.
The parties have all agreed to re-convene the conference call on Tuesday August 16, 2011.

First Contact with the Arbitrator – (Urban Bargaining Unit):
On August 2, 2011, Cloutier A.A. Osborne (the Arbitrator) contacted Canada Post and the Union, by e-mail, and requested that he have a conference call with both parties to discuss the schedule. The Union immediately responded and this discussion is now planned for this afternoon (Thursday August 11, 2011).
Preparations Continue - CUPW’s National Executive Board has been having discussions concerning the position that the Union will take as part of the final selection arbitration process. This is a complex issue as the process requires both parties to submit their entire positions, in contract language, and then the arbitrator chooses one parties’ position in its entirety.
Research is being conducted and presentations prepared on the issues that will be subject of the arbitration. Meetings with legal council have also taken place in order to discuss the Union’s constitutional challenge to the back-to-work legislation. *posted August 11, 2011.
